Det betyr at asyls\u00f8kerens grunner til \u00e5 frykte retur til hjemlandet ikke blir vurdert. Isteden vurderer myndighetene om han\/hun trygt kan sendes til et annet land enn hjemlandet. NOAS mener norsk regelverk og praksis p\u00e5 dette omr\u00e5det inneb\u00e6rer risiko for at flyktninger utsettes for alvorlige menneskerettighetsbrudd i strid med Flyktningkonvensjonen.<\/p><p><a href=\"https:\/\/www.udi.no\/ord-og-begreper\/dublin-samarbeidet\/\">Dublin-forordningen<\/a> er et samarbeid mellom EU-landene, Island, Sveits, Liechtenstein og Norge. Forordningen bestemmer hvilket land som har ansvaret for \u00e5 behandle en asyls\u00f8knad. Landene bundet av forordningen, kan nekte realitetsbehandling av en asyls\u00f8knad n\u00e5r ansvaret for behandling av s\u00f8knaden tilh\u00f8rer et annet Dublin-land. Det er i Dublin-saker spesiell grunn til bekymring for s\u00e5rbare asyls\u00f8kere som ved utsendelse til et annet land, eksempelvis <a href=\"https:\/\/asylumineurope.org\/reports\/country\/italy\/\">Italia<\/a> eller <a href=\"https:\/\/asylumineurope.org\/reports\/country\/greece\/\">Hellas<\/a>, risikerer \u00e5 bli nektet adgang til asylprosedyre, et sted \u00e5 bo, og n\u00f8dvendig helsebehandling. Bekymringen er s\u00e6rlig stor n\u00e5r saken gjelder barn.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1006498 elementor-widget elementor-widget-text-editor\" data-id=\"1006498\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Norske myndigheter kan ogs\u00e5 nekte \u00e5 realitetsbehandle asylsaker n\u00e5r asyls\u00f8keren kan henvises til et s\u00e5kalt \u00abtrygt tredjeland\u00bb. Tredjeland er <a href=\"https:\/\/lovdata.no\/lov\/2008-05-15-35\/%C2%A732\">en stat eller et omr\u00e5de<\/a> hvor man tidligere har hatt opphold, og ikke var forfulgt.<\/p><p><a href=\"https:\/\/www.noas.no\/wp-content\/uploads\/2019\/07\/Storskog-rapport-februar-2019.pdf\">Viktige rettssikkerhetsgarantier ved slik henvisning ble fjernet<\/a> som del av en rekke innstramninger innf\u00f8rt etter \u00f8kte asylankomster over <a href=\"https:\/\/www.riketstilstand.noas.no\/2018\/storskog\">Storskog<\/a> i 2015. Det er ikke lenger et krav at asyls\u00f8keren m\u00e5 ha tilgang til en asylprosedyre i det landet han\/hun sendes til. Norge har <a href=\"https:\/\/www.noas.no\/wp-content\/uploads\/2022\/05\/NOAS_Seeking-Asylum-in-Norway_MATERIE_25.01.pdf\">henvist asyls\u00f8kere til tredjeland som Kuwait, Saudi Arabia og Emiratene<\/a>, som verken har asylprosedyre eller andre rettsikkerhetsgarantier som hindrer at flyktninger blir videresendt til forf\u00f8lgelse i hjemlandet.<\/p><p>\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-25 elementor-top-column elementor-element elementor-element-4544f223\" data-id=\"4544f223\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-590c239 elementor-widget elementor-widget-text-editor\" data-id=\"590c239\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>\u201cNorge har ratifisert FNs flyktningkonvensjon. Allikevel bryter norske myndigheter konvensjonen .\u201d<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-5de91e8b elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"5de91e8b\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-25 elementor-top-column elementor-element elementor-element-3f915d10\" data-id=\"3f915d10\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-54426a98\" data-id=\"54426a98\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-1cdf28ea elementor-widget elementor-widget-heading\" data-id=\"1cdf28ea\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\"><b>Fratar flyktninger rett til status som flyktning <\/b><\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e78e049 elementor-widget elementor-widget-text-editor\" data-id=\"e78e049\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>I september 2022 sendte regjeringen en <a href=\"https:\/\/www.regjeringen.no\/no\/dokumenter\/instruks-gi-152022-vurdering-av-vilkarene-for-asyl-i-utlendingsloven-28-forste-ledd-nar-sokeren-allerede-har-oppholdstillatelse-i-norge\/id2928017\/\">instruks<\/a> til Utlendingsdirektoratet om at dersom en asyls\u00f8ker allerede har permanent oppholdstillatelse i Norge, eller en midlertidig oppholdstillatelse som senere kan gi permanent opphold, vil det som utgangspunkt ikke foreligge noen umiddelbar fare for forf\u00f8lgelse siden personen ikke m\u00e5 reise hjem. Regjeringen mener personen dermed ikke vil kvalifisere til oppholdstillatelse med flyktningstatus i Norge i tr\u00e5d med Flyktningkonvensjonen.<\/p><p>Dette mener NOAS er en feilaktig, innskrenkende tolkning av konvensjonen. Tolkningen strider mot ordlyden i konvensjonens artikkel 1 A, som er tatt inn i <a href=\"https:\/\/lovdata.no\/lov\/2008-05-15-35\/\u00a728\">utlendingsloven \u00a7 28<\/a>. Der st\u00e5r det blant annet at en utlending som er i Norge eller p\u00e5 norsk grense, etter s\u00f8knad skal anerkjennes som flyktning dersom utlendingen:<\/p><p><em>\u00abhar en velbegrunnet frykt for forf\u00f8lgelse p\u00e5 grunn av etnisitet, avstamning, hudfarge, religion, nasjonalitet, medlemskap i en spesiell sosial gruppe eller p\u00e5 grunn av politisk oppfatning, og er ute av stand til, eller p\u00e5 grunn av slik frykt er uvillig til, \u00e5 p\u00e5berope seg sitt hjemlands beskyttelse.\u00bb<\/em><\/p><p>Personer som er flyktninger etter denne definisjonen, har rett til beskyttelse i Norge og de rettighetene som f\u00f8lger av det. Konvensjonen inneholder en rekke forpliktelser for \u00e5 sikre flyktningers spesielle behov, for eksempel forpliktelse til \u00e5 utstede reisebevis for flyktninger. Flyktninger som er forfulgt av hjemlandets myndigheter, kan ikke opps\u00f8ke disse myndighetene for \u00e5 f\u00e5 ID-dokument.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-25 elementor-top-column elementor-element elementor-element-2ccad96e\" data-id=\"2ccad96e\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-f422efc elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"f422efc\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-25 elementor-top-column elementor-element elementor-element-c712afb\" data-id=\"c712afb\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-11ddb80\" data-id=\"11ddb80\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-ce8a3e3 elementor-widget elementor-widget-text-editor\" data-id=\"ce8a3e3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Norske myndigheter kan ikke se bort fra retten til \u00e5 f\u00e5 opphold med flyktningstatus i Norge ved \u00e5 vise til at flyktningen har en annen form for oppholdstillatelse her. Instruksen fremst\u00e5r som et fors\u00f8k p\u00e5 \u00e5 omg\u00e5 forpliktelsene i Flyktningkonvensjonen.<\/p><p>NOAS har sendt et <a href=\"https:\/\/www.noas.no\/ressursbank\/noas-mener\/horingsuttalelser\/\">brev<\/a> til Justis- og beredskapsdepartementet, der vi viser hvorfor vi er uenige med departementets tolkning av konvensjonen og ber om at instruksen revurderes. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-25 elementor-top-column elementor-element elementor-element-05df73b\" data-id=\"05df73b\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div til en annen og tryggere del av hjemlandet. Internflukt er en regel som er innfortolket i flyktningkonvensjonen, som et unntak fra de ordin\u00e6re reglene om beskyttelse. If\u00f8lge folkeretten skal internfluktalternativet bare brukes hvis det finnes et trygt omr\u00e5de i hjemlandet som er tilgjengelig for asyls\u00f8keren, og det er rimelig \u00e5 henvise personen dit.<\/p><p>I juni 2016 <a href=\"https:\/\/www.stortinget.no\/no\/Saker-og-publikasjoner\/Saker\/Sak\/?p=64502\">vedtok Stortinget<\/a> at rimelighetskravet skulle fjernes fra utlendingsloven. Det til tross for at b\u00e5de FNs h\u00f8ykommiss\u00e6r for flyktninger (UNHCR), samtlige flyktningrettseksperter, Advokatforeningen og Utlendingsnemnda i <a href=\"https:\/\/www.regjeringen.no\/no\/dokumenter\/horing--endringer-i-utlendingslovgivningen-innstramninger-ii\/id2469054\/\">h\u00f8ringsrunden<\/a> mente at rimelighetsvilk\u00e5ret ikke kunne fjernes. Flere av dem sa klart at det er en folkerettslig forpliktelse \u00e5 vurdere rimelighet dersom internfluktalternativet skal benyttes.<\/p><p>Endringen inneb\u00e6rer at det ikke lenger gj\u00f8res en vurdering av om det er rimelig \u00e5 avsl\u00e5 en asyls\u00f8knad og henvise asyls\u00f8keren til en annen del av hjemlandet. S\u00e5 lenge det finnes et omr\u00e5de i landet som anses som trygt og som er tilgjengelig for asyls\u00f8keren, kan personen henvises dit og gis avslag p\u00e5 asyls\u00f8knaden, uansett hvor vanskelige livsvilk\u00e5rene vil v\u00e6re der. Det betyr at flyktninger som har f\u00e5tt trygghet i Norge, kan sendes tilbake til hjemlandet p\u00e5 grunn av forhold som ikke skyldes flyktningenes egne handlinger. \u00a0<\/p><p>Bruk av opph\u00f8rsbestemmelsen har f\u00f8rst og fremst rammet somaliske flyktninger. Utlendingsdirektoratet (UDI) vurderte \u00e5 trekke tilbake tillatelsen til en stor gruppe somaliske flyktninger som kom til Norge mellom 2012 og 2014, som risikerte \u00e5 m\u00e5tte returnere til Mogadishu \u2013 i strid med flyktningkonvensjonen.
