Internflukt inneb\u00e6rer at en asyls\u00f8ker som risikerer forf\u00f8lgelse p\u00e5 hjemstedet, likevel kan f\u00e5 avslag og henvises til en annen og tryggere del av hjemlandet. I juni 2016 vedtok Stortinget at rimelighetskravet skulle fjernes fra utlendingsloven. Det betyr at det ikke lenger skal gj\u00f8res en vurdering av om det er rimelig i det konkrete tilfellet \u00e5 avsl\u00e5 asyls\u00f8knaden og henvise asyls\u00f8keren til en annen del av hjemlandet. S\u00e5 lenge det finnes et omr\u00e5de i landet som anses som trygt, og som er tilgjengelig for asyls\u00f8keren, kan personen sendes dit, uansett hvor vanskelige livsvilk\u00e5rene vil v\u00e6re der. Ikke minst for enslige mindre\u00e5rige asyls\u00f8kere har konsekvensene v\u00e6rt dramatiske. Tidligere ble det ansett som urimelig \u00e5 henvise enslige mindre\u00e5rige asyls\u00f8kere til et omr\u00e5de der de ikke har omsorgspersoner. De som ikke kunne returnere til hjemstedet fordi de risikerte forf\u00f8lgelse der, fikk dermed beskyttelse. N\u00e5 skal det n\u00e5 ikke lenger gj\u00f8res en vurdering av om det er rimelig \u00e5 henvise ungdommer til et sted hvor de mangler omsorgspersoner. Da anses de ikke \u00e5 ha beskyttelsesbehov, og dermed er det \u00e5pning for \u00e5 gi dem en midlertidig tillatelse som inneb\u00e6rer at de m\u00e5 forlate Norge n\u00e5r de fyller 18 \u00e5r. I l\u00f8pet av 2016 har det v\u00e6rt en <a href=\"\/2016\/ungdommer-p-flukt\">kraftig \u00f8kning i antallet midlertidige tillatelser til enslige mindre\u00e5rige asyls\u00f8kere<\/a>. De fleste av disse vedtakene ble fattet etter at de nye reglene om internflukt tr\u00e5dte i kraft i oktober.<\/p><p style=\"white-space:pre-wrap;\">Ogs\u00e5 barnefamilier, enslige kvinner, personer med alvorlige sykdommer eller funksjonshemminger er blant dem som rammes av innstrammingen. Tidligere kunne slike forhold inneb\u00e6re at det ikke ble ansett som rimelig \u00e5 henvise personene til en ukjent del av landet, hvor de ofte mangler nettverk. I dag er ikke slike argumenter lenger relevante for om det skal gis beskyttelse. Denne tolkningen st\u00e5r de noks\u00e5 alene om. B\u00e5de FNs h\u00f8ykommiss\u00e6r for flyktninger (UNHCR), samtlige flyktningrettseksperter, Advokatforeningen og fagorganet Utlendingsnemnda var uenige i departementets syn. Flere av dem sa klart at det er en folkerettslig forpliktelse \u00e5 vurdere rimelighet dersom internfluktalternativet skal benyttes. H\u00f8ringsuttalelsene kan leses <a href=\"https:\/\/www.regjeringen.no\/no\/dokumenter\/horing--endringer-i-utlendingslovgivningen-innstramninger-ii\/id2469054\/\">her<\/a>.<\/p>\n\n\n<\/div><\/div><div class=\"sqs-block quote-block sqs-block-quote null\" data-block-type=\"31\" id=\"block-yui_3_17_2_42_1496002582154_46924\"><div class=\"sqs-block-content\">\n\n\n\n<figure class=\"block-animation-none\">\n  <blockquote data-animation-role=\"quote\">\n    <span>\u201c<\/span>Allerede f\u00f8r regelendringen var Norges internfluktpraksis blant de strengeste i Europa, kanskje den aller strengeste.<span>\u201d<\/span>\n  <\/blockquote>\n  \n<\/figure>\n<\/div><\/div><div class=\"sqs-block html-block sqs-block-html\" data-block-type=\"2\" id=\"block-yui_3_17_2_42_1496002582154_69811\"><div class=\"sqs-block-content\"><p style=\"white-space:pre-wrap;\">For f\u00e5 \u00e5r siden mente ogs\u00e5 departementet selv at Norge er forpliktet etter folkeretten til \u00e5 vurdere rimeligheten i hvert tilfelle hvis de skal henvise asyls\u00f8kere til internflukt. I forarbeidene til utlendingsloven fra 2008 ble det forutsatt at rimelighetsvurderingen er en folkerettslig forpliktelse. Under Solberg-regjeringen har imidlertid departementet endret standpunkt.<br>&nbsp;<\/p><h2 style=\"white-space:pre-wrap;\">Tynt kildegrunnlag<\/h2><p style=\"white-space:pre-wrap;\">Departementet begrunnelse for \u00e5 hevde at rimelighetsvurdering ikke er et krav etter folkeretten, var tynn. I h\u00f8ringsnotatet viste de til to kilder, som begge m\u00e5tte fjernes fra lovforslaget de senere la fram: H\u00f8yesteretts plenumsdom var sitert feil, og den tyske flyktningrettseksperten Andreas Zimmermanns syn var ikke riktig presentert. Han gikk ut og <a href=\"http:\/\/www.klassekampen.no\/article\/20160216\/PLUSS\/160219821\" target=\"_blank\">protesterte<\/a> p\u00e5 departementets framstilling av hva han skriver i sitt standardverk om flyktningretten.&nbsp;<\/p><p style=\"white-space:pre-wrap;\">Jussprofessor og flyktningrettsekspert Terje Einarsen var <a href=\"https:\/\/www.regjeringen.no\/no\/dokumenter\/horing--endringer-i-utlendingslovgivningen-innstramninger-ii\/id2469054\/?uid=b5527b26-3624-479b-b530-7f679843199c\" target=\"_blank\">sterkt kritisk<\/a> til departementets kildebruk p\u00e5 dette punktet. Han karakteriserte den som s\u00e5 tendensi\u00f8s at det var grunn til \u00e5 lure p\u00e5 om form\u00e5let var \u00e5 villede de folkevalgte for \u00e5 f\u00e5 gjennom en lovendring man ellers ikke ville f\u00e5tt Stortinget med p\u00e5.<\/p><p style=\"white-space:pre-wrap;\">Departementet eneste argument var at ulike lands praktisering av rimelighetsvilk\u00e5ret varierer. De hevdet at det viser at det ikke finnes noen klar folkerettslig forpliktelse. Mot dette kan innvendes at alle vestlige land opererer med et rimelighetsvilk\u00e5r, noe blant annet Utlendingsnemnda viste i sitt h\u00f8ringssvar. Rimelighetsvurderingen er tatt inn som et vilk\u00e5r i EUs statusdirektiv, det vil si at alle EU-land m\u00e5 vurdere rimelighet i internfluktsaker. Variasjonen i statspraksis knytter seg til <em>hvordan <\/em>vurderingen gj\u00f8res, og ikke <em>hvorvidt <\/em>det skal gj\u00f8res en rimelighetsvurdering. Allerede f\u00f8r regelendringen var Norges internfluktpraksis blant de strengeste i Europa, kanskje den aller strengeste.
