Bruk av opph\u00f8rsbestemmelsen inneb\u00e6rer at Norge leder an internasjonalt i \u00e5 svekke flyktningers rettigheter. Flyktninger som har bodd flere \u00e5r i Norge kan miste oppholdstillatelsen her, og sendes tilbake til hjemlandet p\u00e5 grunn av forhold som ikke skyldes flyktningens egne handlinger.\n\nOpph\u00f8r m\u00e5 skilles fra tilbakekall\/kansellering. Rapporten viser at Norge bryter FNs flyktningkonvensjon, Den europeiske menneskerettskonvensjonen og den norske utlendingsloven med dagens praksis for opph\u00f8r av flyktningstatus.\n\nBruk av opph\u00f8rsbestemmelsen har s\u00e5 langt f\u00f8rst og fremst rammet somaliske flyktninger. UDI vurderer \u00e5 trekke tilbake tillatelsen til en stor gruppe somaliske flyktninger som kom til Norge mellom 2012 og 2014, som risikerer \u00e5 m\u00e5tte returnere til Mogadishu \u2013 i strid med flyktningkonvensjonen. I et\u00a0<a href=\"https:\/\/static1.squarespace.com\/static\/56e6a2632b8dde4bafc35e0b\/t\/592ca461893fc05fa7db5afe\/1496097890960\/Brev+fra+UNHCR+om+opph%25C3%25B8r+Somalia-saker+7.+nov+2016.pdf.\">brev<\/a>\u00a0til norske myndigheter, advarer UNHCR om at sikkerhetssituasjonen i Mogadishu er for usikker til at flyktningstatus kan opph\u00f8re.\n\n<a href=\"https:\/\/www.regjeringen.no\/no\/dokumenter\/gi-142016--revidert-instruks-om-tilbakekall-av-flyktningstatus-og-oppholds-tillatelse-nar-beskyttelsesbehovet-er-bortfalt-jf.-utlendingsloven--37-forste-ledd-bokstav-e-og-f\/id2513169\/\">Regjeringen har instruert utlendingsmyndighetene<\/a>\u00a0om \u00e5 vurdere internflukt i opph\u00f8r-saker. Det vil si at flyktninger kan miste oppholdstillatelsen i Norge og sendes til en annen del av hjemlandet enn der de kommer fra. De som ikke oppfyller vilk\u00e5rene for permanent opphold, kan leve i konstant usikkerhet for om de vil bli sendt tilbake til hjemlandet \u2013 ogs\u00e5 etter mange \u00e5rs opphold i Norge.\n\nFlyktningene intervjuet i rapporten utgitt av NOAS, Redd Barna og FO, forteller at opph\u00f8rspraksisen har f\u00f8rt til svekket psykisk helse, manglende konsentrasjon og motivasjon til \u00e5 fokusere p\u00e5 skole og jobb, svekket tillit til norske myndigheter, og en sterk opplevelse av \u00e5 bli urettferdig forskjellsbehandlet i et politisk spill.\n\n<em>\u2013 Jeg ble ferdig med introduksjonsprogrammet og var i fast jobb i 2015. S\u00e5 kom instruksen fra Justis i 2016, det virkelig \u00f8dela livet mitt. All motivasjonen jeg hadde som hjalp meg med \u00e5 integrere meg s\u00e5 fort forsvant, sier en av de somaliske flyktningene.<\/em>\n\nSv\u00e6rt f\u00e5 har s\u00e5 langt f\u00e5tt endelig vedtak om opph\u00f8r av flyktningstatus.
