Manglende rettssikkerhet i UNE fremkommer av en rekke utredninger og evalueringer. <a href=\"https:\/\/www.regjeringen.no\/no\/dokumenter\/nou-2017-8\/id2542284\/\">Graverutvalgets utredning<\/a> fra mars 2017, peker p\u00e5 s\u00e6rlig to svakheter ved rettssikkerheten i dagens klageordning i asylsaker: Mangel p\u00e5 kontradiksjon og mangel p\u00e5 UNE vurderer i en del asylsaker andre forhold enn Utlendingsdirektoratet (UDI), uten at asyls\u00f8keren gis mulighet til \u00e5 uttale seg om de nye vurderingene.<\/span><span style=\"letter-spacing: 0.3px;\"><br \/><\/span><\/p><p><span style=\"letter-spacing: 0.3px;\">For eksempel kan UDI avsl\u00e5 en asyls\u00f8knad og henvise s\u00f8ker til internflukt i det norske myndigheter mener er en tryggere del av hjemlandet. I klagebehandlingen i UNE, kan nemnda opprettholde UDIs avslag p\u00e5 s\u00f8knad om beskyttelse, men n\u00e5 med begrunnelse at de ikke tror p\u00e5 asyls\u00f8kerens historie. I saker hvor UNEs behandling utelukkende er basert p\u00e5 innsendte skriftlige dokumenter, noe som gjelder de aller fleste saker, vil asyls\u00f8keren ikke ha mulighet til \u00e5 im\u00f8teg\u00e5 UNEs nye vurderinger ved \u00e5 oppklare misforst\u00e5elser eller legge fram viktige tilleggsopplysninger. Slik manglende kontradiksjon \u00f8ker risikoen for at UNE fatter feil vedtak.<\/span><span style=\"letter-spacing: 0.3px;\"><br \/><\/span><\/p><p><span style=\"letter-spacing: 0.3px;\">Manglende kontradiksjon svekker rettssikkerheten og er s\u00e6rlig alvorlig i asylsaker, der et galt vedtak kan bety at mennesker returneres til forf\u00f8lgelse \u2013 som vil v\u00e6re et brudd p\u00e5 Norges internasjonale forpliktelser.<\/span><span style=\"letter-spacing: 0.3px;\"><br \/><\/span><\/p><p><span style=\"letter-spacing: 0.3px;\">Et godt skritt p\u00e5 veien for \u00e5 sikre full kontradiksjon og muntlig h\u00f8ring, er \u00e5 innf\u00f8re en topartsprosess i UNE \u2013 som man har i de tilsvarende klageorganene i b\u00e5de Danmark og Sverige. En reell topartsprosess inneb\u00e6rer at f\u00f8rsteinstans i asylsaker, UDI, m\u00f8ter asyls\u00f8keren og hans\/hennes advokat som motparter i UNE. Da vil UDI kunne sp\u00f8rres ut om sitt avslag av b\u00e5de UNE og asyls\u00f8keren\/advokaten. Les mer her.<\/span><\/p><h2><b>F\u00e5 f\u00e5r forklare seg muntlig<\/b><\/h2><p>Et viktig form\u00e5l med opprettelsen av UNE i 2001, var at flere s\u00f8kere skulle gis mulighet til \u00e5 forklare seg muntlig under klagebehandlingen. Men i 2021\u00a0<a href=\"https:\/\/www.une.no\/globalassets\/om-une\/arsrapporter-etc\/arsrapport-une-2021.pdf\">fikk kun 9 prosent av asyls\u00f8kerne mulighet til \u00e5 forklare seg muntlig<\/a>\u00a0for UNE. I\u00a0<a href=\"https:\/\/www.une.no\/statistikk\/familieinnvandring\/\">familieinnvandringssaker<\/a>\u00a0fikk under 1 prosent mulighet til muntlig forklaring.<\/p><p>If\u00f8lge utlendingsloven skal det gjennomf\u00f8res nemndm\u00f8te i saker der det foreligger \u00abvesentlige tvilssp\u00f8rsm\u00e5l\u00bb, det vil si tvil om sp\u00f8rsm\u00e5l som kan ha betydning for resultatet i saken. Det er den enkelte beslutningstager i UNE som selv bestemmer om det skal holdes nemndm\u00f8te i den enkelte saken. Dersom det gjennomf\u00f8res nemndm\u00f8te, skal asyls\u00f8keren if\u00f8lge utlendingsloven som hovedregel f\u00e5 mulighet til \u00e5 forklare seg muntlig.<\/p><p><span style=\"letter-spacing: 0.3px;\">Muntlig forklaring er viktig for \u00e5 opplyse saken og styrke den enkeltes rettssikkerhet, og vil bidra til at det fattes riktige vedtak. Muligheten til \u00e5 bli h\u00f8rt er viktig for opplevd og reell rettssikkerhet. Flere muntlige behandlinger vil gi UNEs avgj\u00f8relser mer legitimitet, b\u00e5de hos den vedtaket gjelder og i allmennheten.<\/span><\/p><h2>Sm\u00e5 endringer<\/h2><div><p>I juni 2021 <a href=\"https:\/\/www.regjeringen.no\/no\/dokumentarkiv\/regjeringen-solberg\/aktuelt-regjeringen-solberg\/jd\/pressemeldinger\/2021\/utvidet-rett-til-nemndmotebehandling-i-utlendingsnemnda-for-konvertitter\/id2863247\/\">meldte Solberg-regjeringen<\/a> om <a href=\"https:\/\/www.noas.no\/asylsokere-som-endrer-tro-far-fra-1-august-mote-i-nemnd-hos-utlendingsnemnda-une\/\">nye regler<\/a> som utvider retten til nemndm\u00f8tebehandling i UNE for <a href=\"https:\/\/noas.no\/riketstilstand\/iran\/\">konvertitter<\/a>. Det gis n\u00e5 rett til nemndm\u00f8tebehandling i asylsaker hvor et av vurderingstemaene er troverdigheten av anf\u00f8rsler om skifte av religion, med mindre s\u00e6rlige grunner taler imot det. Det gis ogs\u00e5 en tydeligere rett enn i dag til \u00e5 f\u00f8re vitner i denne typen saker.<\/p><h2 class=\"\">L\u00f8sning: s\u00e6rdomstol og topartsprosess<\/h2><div><p>En s\u00e6rdomstol vil v\u00e6re den beste l\u00f8sningen for klagebehandling p\u00e5 utlendingsrettens omr\u00e5de.<\/p><p><span style=\"letter-spacing: 0.3px; background-color: var(--ast-global-color-5);\">Et godt skritt p\u00e5 veien for \u00e5 sikre full kontradiksjon og muntlig h\u00f8ring, er \u00e5 innf\u00f8re en topartsprosess i UNE \u2013 som man har i de tilsvarende klageorganene i b\u00e5de Danmark og Sverige.
